'User' The individual or person whom is using digital-zest.com (that would be you)

'Site' The website located @ http://www.digital-zest.com including all The content therein.

'Content' All content, including but not limited to all written text, images, graphics, code, animations, icons, website templates (webkits) that comprise the Website.

'Digital-Zest.com' The entire website located at http://www.digital-zest.com including all The content therein.

A. This Agreement shall be governed by the laws of England and Wales which shall claim venue and jurisdiction for any legal motion or claim arising from this Agreement. This Agreement is void where prohibited by law.

B. Where one or more terms of this contract are held to be void or unenforceable for whatever reason, any other terms of the contract not so held will remain valid and enforceable at law.

Under no circumstances shall Digital-Zest be liable for any conduct of any person or persons that is associated with the usage of the Websites.

The User may use the Content for producing their own personal websites, or websites for their own business, provided the websites belong to the User, and that the User does not imply or suggest that they created the Content or that they claim any ownership of copyright over the Content. The Content may not be used to produce material that is racist, obscene, pornographic or otherwise of an adult nature.

The user may not use the Digital-Zest fruit sticker logo, wording, graphics, or any other element or elements that comprise Digital-Zest's branding or the Websites' general "look and feel", to produce a website or any other work.

The User may not use the Content to produce derivative work for a third party.

You can use our free WebKits for your (coffee shop, insurance company, sports shop, etc) business and make money from the website. However, if you are a web designer/developer you are not allowed to develop websites using our WebKits for your clients, wether for profit or not-for-profit. Also you may not take our WebKits or any other website material and use it on your website as an example or a download without full written permission.

If you are a website designer/developer, you may not use any of the content to produce your web design site, or claim that any of the content was produced by you, or use any of the content as examples of your portfolio.

Redistributing the Content, or any portion thereof, in any form, under any name, on its own or with other products (commercial or otherwise), without the prior written permission of Digital-Zest is forbidden.

The User may not redistribute any part of the Content on another website, on a CD-ROM, or on any other form of media without the prior written permission of Digital-Zest.

The User may not sell, rent, or lease the Content and/or Graphics to any individual or organization.

The User may not use any of the Content to design or create websites or any other derivative work for a third party, whether for free or for profit, unless given written permission by Digital-Zest.
